Terms of Service

• "Platform" means the Mitho Map website, mobile applications, and related services.
• "User," "You," "Your" means any individual or entity using the Platform.
• "Restaurant Partner" means a restaurant listed on the Platform offering food for delivery.
• "Delivery Partner" means an independent contractor who delivers orders from restaurants to users.
• "Order" means a request for food delivery placed through the Platform.

You must be at least 18 years old to create an account and use our Platform. By creating an account, you represent that you are legally capable of entering into binding contracts. If you are using the Platform on behalf of an entity, you represent that you have the authority to bind that entity to these Terms.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. We are not liable for any loss or damage arising from your failure to protect your account.

• All orders placed through the Platform are subject to availability and restaurant acceptance.
• Prices are displayed in Nepalese Rupees (NPR) and include applicable taxes unless stated otherwise.
• Payment is due at the time of ordering. We accept cash on delivery, mobile banking, eSewa, Khalti, and credit/debit cards.
• Your payment will be processed securely by our third-party payment processors. We do not store full payment card details.
• Delivery charges, if any, will be clearly displayed before you confirm your order.

• You may cancel an order within 3 minutes of placing it, provided the restaurant has not yet started preparing the order.
• Once the restaurant begins preparation, cancellations are at the restaurant's discretion.
• If an order cannot be fulfilled (e.g., restaurant is closed, item unavailable), we will refund the full amount within 7-10 business days.
• Refunds for quality issues are handled on a case-by-case basis. Please contact our support team within 24 hours of delivery.

You agree not to:

• Use the Platform for any unlawful purpose or in violation of any applicable law.
• Attempt to interfere with the Platform's operation, including introducing malware or conducting denial-of-service attacks.
• Create multiple accounts for fraudulent purposes, including abuse of referral programs or promotional offers.
• Harass, abuse, or harm other users, restaurant partners, or delivery partners.
• Submit false or misleading information, including fake reviews or inaccurate delivery addresses.
• Reverse engineer, decompile, or attempt to extract the source code of our Platform.

If you list your restaurant on our Platform, you additionally agree to:

• Maintain accurate menu, pricing, and availability information.
• Prepare and package orders to a standard suitable for delivery.
• Accept and process orders in a timely manner as per our agreed service levels.
• Comply with all applicable food safety and hygiene regulations.
• Pay applicable commission fees as outlined in your separate agreement with us.

If you deliver orders through our Platform, you additionally agree to:

• Maintain a valid driver's license, vehicle insurance, and any required permits.
• Deliver orders in a timely and professional manner, maintaining food quality during transit.
• Follow all traffic laws and safety regulations.
• Use the Platform's tracking and communication features as intended.
• You are an independent contractor, not an employee of Mitho Map.

The Mitho Map name, logo, design, text, graphics, software, and all other content on the Platform are owned by or licensed to Mitho Map and are protected by intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our express written consent.

You agree to indemnify and hold harmless Mitho Map, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses (including legal fees) arising from your use of the Platform, violation of these Terms, or infringement of any third-party rights.

We reserve the right to suspend or terminate your access to the Platform at any time, without prior notice, for violations of these Terms, fraudulent activity, or conduct that we determine to be harmful to the Platform or other users. Upon termination, your right to use the Platform immediately ceases. Sections 9, 10, 11, 13, and 14 survive termination.

• Informal Resolution: Before initiating any formal dispute, you agree to contact us at [email protected] and attempt to resolve the issue informally for 30 days.
• Arbitration: If the dispute cannot be resolved informally, it shall be resolved by binding arbitration in Birgunj, Nepal, in accordance with the Arbitration Act of Nepal.
• Class Action Waiver: Any dispute resolution proceedings will be conducted on an individual basis only, not as a class, consolidated, or representative action.

These Terms shall be governed by and construed in accordance with the laws of Nepal. Any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the courts of Birgunj, Nepal.

We may update these Terms from time to time. Material changes will be communicated via email or in-app notification. Your continued use of the Platform after changes take effect constitutes acceptance of the updated Terms. If you do not agree, you must stop using the Platform.
